| Only for commercial use! 1. Conclusion of agreement The agreement shall come into effect when the customer's order has been accepted by ELSPRO Elektrotechnik GmbH & Co. KG and has been confirmed by a written acknowledgement of order. 2. Retention of title ELSPRO Elektrotechnik GmbH & Co. KG reserves the ownership rights regarding the delivered goods until final payment has been made. 3. Warranty The statutory warranty period applies. ELSPRO Elektrotechnik GmbH & Co. KG guarantees that the delivered goods have the characteristics agreed, if any, and are suitable for the standard purpose at the time of delivery. Any guarantee claims are subject to the condition that the fault was not caused by incorrect use of the goods. If a fault is established, the customer shall be entitled to demand delivery of a fault-free replacemen or withdraw from the agreement. If the customer decides to withdraw from the agreement, ELSPRO Elektrotechnik GmbH & Co. KG shall refund the purchase price. Indemnity claims due to faults in the delivered goods are excluded, unless ELSPRO Elektrotechnik GmbH & Co. KG has maliciously or wilfully concealed the fault or has provided guarantee for the condition and characteristics of the goods. 4. Legal venue Legal venue is the registered place of business of ELSPRO Elektrotechnik GmbH & Co. KG . The agreement is subject to the law of the Federal Republic of Germany with exclusion of UN commercial law. 5. Miscellaneous If any provision of this agreement is void or ineffective in law in part or in full or is found to be in breach of statutory provisions, this shall not affect the validity of the agreement as a whole. The contract partners undertake in this case to replace the void or ineffective provision with some valid regulation that comes as close as possible to the commercial intention of the original. 6. Data protection Your data will be stored in our computer system for purposes of order processing. All data provided to us will be treated in accordance with German data protection law. |
